The High Court in Kampala has annulled the election of Elias Nalukoola Luyimbazi as the Member of Parliament (MP) for Kawempe North, citing substantial irregularities in the recent by-election.

The ruling, delivered by Justice Bernard Namanya, also orders the Electoral Commission to organize a fresh election for the constituency.

Justice Namanya declared the seat for the Directly Elected Member of Parliament for Kawempe Division North in Kampala District vacant. He ruled that the by-election, held in March 2025, did not comply with the Parliamentary Elections Act and that the identified irregularities significantly influenced the results.

“The election of Luyimbazi Elias Nalukoola… is set aside,” the judge stated in the ruling. “The seat is declared vacant, and the Electoral Commission is ordered to conduct a fresh election.”

The ruling is as a result of a petition filed by the National Resistance Movement (NRM) and its candidate, Hon. Nambi Faridah Kigonogo. The petition accused the Electoral Commission of failing to return results from several polling stations, leading to the disenfranchisement of a large number of voters.

Further claims included voter bribery, obstruction of polling officials, and illegal campaign practices allegedly carried out by Luyimbazi’s team.

This latest development marks the second time the Kawempe North parliamentary seat has faced legal battles. The March 2025 by-election itself was conducted after the court nullified Muhammad Ssegirinya’s 2021 election on similar grounds.

Justice Namanya ruled that each party will bear its own legal costs.

The Electoral Commission is now under pressure to set a timeline for a new election, which will determine the legitimate representative for Kawempe North.
